We recently acted for a business owner who had grabbed some free terms and conditions online, thinking they worked fine, but they didn’t. Turns out they were terms and conditions from a US company with clauses that made no legal sense in the UK. Worse still, because they hadn’t had the terms and conditions drafted for them or even checked over, they accidentally agreed to pay damages when they needn’t have done so. There was nothing in the terms and conditions to limit their liability to the other party.

A bad contract is worse than no contract. So, please don’t rely on templates you find online. Get one that actually protects you, or, at the very least, get a lawyer to give your contracts the once-over and flag any key areas of concern before you sign.
