Settlement Agreements

Newtons employment team is hugely experienced in negotiating and advising on Settlement Agreements for senior executives and employers.

By signing a Settlement Agreement, employees normally waive their rights to bring claims in the Employment Tribunal or County Court about their employment or why and how it ended.  We can talk you through the terms of your proposed agreement and fully advise you on the implications of signing.

As well as discussing the financial terms, we can guide you through other provisions you might want to include, such as confidentiality agreements, restrictions on where you can work after your employment ends and asking your employer to provide an agreed form reference.

It is legal requirement for an employee to obtain independent legal advice before signing a Settlement Agreement – the costs of which are usually met by the employer.  In this case we would normally invoice the employer directly and they would make payment direct to us.

For employers we can advise on how and when talk to an employee about the possible amicable termination of their employment.
